摘要

在侦查阶段的过程中犯罪嫌疑人的自由是被剥夺的，所以犯罪嫌疑人处于比较弱势的地位，这样就会导致犯罪嫌疑人的所应有的权利就可能会大大的侵害，所以对于羁押当事人的权利的保护是非常重要的。
自然理性是人的认识对客观规律的尊重和遵循。人的认识能力是能够透过现象看到本质。而法的预期是对人的自然需求的一种理性把握。因此，本文首先对于侦查阶段犯罪嫌疑人权利的内涵进行分析，界定了何为侦查阶段，何为犯罪嫌疑人，界定了自然人权，为本文提供了理论基础。然后通过对于侦查阶段在押犯罪嫌疑人权利保障存在的问题进行有效的分析，提出在侦查阶段也应合理保障犯罪嫌疑人的基本人权，并对当前中国在侦查阶段所存在的不足给予了分析与交代，最后提出有针对性的建议，希望能够落实司法审查，加大律师参与度，以期本文的研究的结果能够完善我国侦查阶段犯罪嫌疑人权利保障体系。

Abstract

Intheprocessofinvestigation,thefreedomofthecriminalsuspectisdeprived,sothecriminalsuspectisinarelativelyweakposition,whichwillleadtothecriminalsuspect'sduerightsmaybegreatlyinfringed,sotheprotectionoftherightsofthedetainedpartiesisveryimportant.
Amongthem,naturalrationalityistherespectandobedienceofhumanunderstandingtoobjectivelaws.Human'scognitiveabilityistoseetheessencethroughphenomena.Theexpectationoflawisarationalgraspofman'snaturalneeds.Therefore,thispaperfirstanalysestheconnotationofthesuspect'srightsintheinvestigationstage,defineswhatistheinvestigationstage,whatisthesuspect,anddefinesthenaturalhumanrights,whichprovidesthetheoreticalbasisforthisarticle.Then,throughtheeffectiveanalysisoftheproblemsexistingintheprotectionoftherightsofcriminalsuspectsindetentionintheinvestigationstage,thispaperputsforwardthatthebasichumanrightsofcriminalsuspectsshouldalsobereasonablyguaranteedintheinvestigationstage,andanalysesandaccountsforthedeficienciesexistingintheinvestigationstageinChinaatpresent.Finally,itputsforwardsomepertinentsuggestions,hopingtoimplementjudicialreviewandincreasetheparticipationoflawyers.TheresultsofthisstudycanimprovetheprotectionsystemofcriminalSuspects'rightsinthestageofinvestigationinourcountry.
