产品责任法律适用公约（1977年10月1日生效） HYPERLINK"http://www.jurisint.org/en/ins/110.html"ConventionontheLawapplicabletoproductsliability(英文版) Http://www.jurisint.org/en/ins/110.html TheStatessignatorytothepresentConvention, Desiringtoestablishcommonprovisionsonthelawapplicable,ininternationalcases,toproductsliability, HaveresolvedtoconcludeaConventiontothiseffectandhaveagreeduponthefollowingprovisions: Article1 ThisConventionshalldeterminethelawapplicabletotheliabilityofthemanufacturersandotherpersonsspecifiedinArticle3fordamagecausedbyaproduct,includingdamageinconsequenceofamisdescriptionoftheproductorofafailuretogiveadequatenoticeonitsqualities,itscharacteristicsoritsmethodofuse. Wherethepropertyin,ortherighttouse,theproductwastransferredtothepersonsufferingdamagebythepersonclaimedtobeliable,theConventionshallnotapplytotheirliabilityinterse. ThisConventionshallapplyirrespectiveofthenatureoftheproceedings. Article2 ForthepurposesofthisConvention: a)theword"product"shallincludenaturalandindustrialproducts,whetherrawormanufacturedandwhethermovableorimmovable; b)theword"damage"shallmeaninjurytothepersonordamagetopropertyaswellaseconomicloss;however,damagetotheproductitselfandtheconsequentialeconomiclossshallbeexcludedunlessassociatedwithotherdamage; c)theword"person"shallrefertoalegalpersonaswellastoanaturalperson. Article3 ThisConventionshallapplytotheliabilityofthefollowingpersons: (1)manufacturersofafinishedproductorofacomponentpart; (2)producersofanaturalproduct; (3)suppliersofaproduct; (4)otherpersons,includingrepairersandwarehousemen,inthecommercialchainofpreparationordistributionofaproduct. Itshallalsoapplytotheliabilityoftheagentsoremployeesofthepersonsspecifiedabove. Article4 TheapplicablelawshallbetheinternallawoftheStateoftheplaceofinjury,ifthatStateisalso: a)theplaceofthehabitualresidenceofthepersondirectlysufferingdamage,or b)theprincipalplaceofbusinessofthepersonclaimedtobeliable,or c)theplacewheretheproductwasacquiredbythepersondirectlysufferingdamage.
