生态环境恢复法律制度研究的中期报告
摘要
本文是生态环境恢复法律制度研究项目的中期报告，对我国生态环境恢复的法律制度进行了系统研究和分析。在对我国生态环境恢复的现状和问题进行阐述后，分别从立法、执法、司法等方面对我国生态环境恢复的法律制度进行了分析和评价。在立法方面，我国已经出台了一系列生态环境保护的法律法规，但在法律适用、处罚力度等方面还有不足之处。在执法方面，存在着执法难度大、执法效率低和执法成本高等问题，在建立执法部门专业化机构、完善执法程序等方面需要加强。在司法方面，需要进一步规范司法程序和司法责任制，完善权益保障机制和责任追究机制，做到严格执法、公正司法。最后，本文提出了我国生态环境恢复法律制度应加强的方向和建议，如完善环境监管体系、加强法律制度宣传和教育、建立生态环境损害公益诉讼制度等，以期促进我国生态环境恢复的法律制度建设。

Abstract
Thisarticleisthemid-termreportoftheresearchprojectonlegalsystemofecologicalenvironmentrestoration,whichsystematicallystudiesandanalyzesthelegalsystemofecologicalenvironmentrestorationinChina.AfterdescribingthecurrentsituationandproblemsofecologicalenvironmentrestorationinChina,thisarticleanalyzesandevaluatesthelegalsystemofecologicalenvironmentrestorationfromtheaspectsoflegislation,lawenforcementandjusticerespectively.Intermsoflegislation,Chinahasissuedaseriesoflawsandregulationsonecologicalenvironmentprotection,buttherearestilldeficienciesinlegalapplicationandpunishment.Intermsoflawenforcement,therearedifficultiesinlawenforcement,lowlawenforcementefficiencyandhighlawenforcementcosts,anditisnecessarytoestablishspecializedlawenforcementagenciesandimprovelawenforcementprocedures.Intermsofjustice,itisnecessarytofurtherstandardizejudicialproceduresandjudicialresponsibilitysystem,improvethemechanismofrightsprotectionandresponsibilityinvestigation,andachievestrictlawenforcementandfairjustice.Finally,thisarticleputsforwardthedirectionandsuggestionsforimprovingthelegalsystemofecologicalenvironmentrestorationinChina,suchasimprovingtheenvironmentalsupervisionsystem,strengtheningthepropagandaandeducationoflegalsystem,andestablishingthepublicinterestlitigationsystemforecologicalenvironmentdamage,soastopromotethelegalsystemconstructionofecologicalenvironmentrestorationinChina.
