Chapter4TheContractor,NominatedSubcontractors,StaffandLabourTHETRINITYOFTHEEMPLOYER,ENGINEER,CONTRACTORThecontractorgetspaidfortheworkheperformsandtheemployergetstheworkheispayingfor.Contractor’sgeneralobligations[4.1]TheContractorshallobtain(athiscost)aPerformanceSecurityforproperperformance,intheamountandcurrenciesstatedintheAppendixtoTender.Contractorshallnotsubcontractthewholeoftheworks.TheContractorshallberesponsiblefortheactsordefaultsofanySubcontractor,asiftheyweretheactsordefaultsoftheContractor.UnlessotherwisestatedintheParticularConditions:承包商就分包商旳违约承担连带责任(a)theContractorshallnotberequiredtoobtainconsenttosuppliersofMaterials,ortoasubcontractforwhichtheSubcontractorisnamedintheContract;——承包商在选择材料供给商或向协议中指明旳分包商进行分包时，不需要取得同意(b)thepriorconsentoftheEngineershallbeobtainedtootherproposedSubcontractors;——对其他提议旳分包商应取得工程师旳同意TheContractorshallsetouttheWorksinrelationtooriginalpoints,linesandlevelsofreferencespecifiedintheContractornotifiedbytheEngineer.TheContractorshallberesponsibleforthecorrectpositioningofallpartsoftheWorks,andshallrectifyanyerrorinthepositions,levels,dimensionsoralignmentoftheWorks.ProgressReports[4.21]DefinitionofNominatedSubcontractor:asubcontractorwhoisstatedinthecontractasbeinganominatedSubcontractor,orwhomtheEngineerinstructstheContractortoemployasaSubcontractor.TheContractorshallnotbeunderanyobligationtoemployanominatedSubcontractoragainstwhomtheContractorraisesreasonableobjectionby……,anobjectionshallbedeemedreasonableifitarisesfromanyofthefollowingmatters,unlesstheemployeragreestoindemnifythecontractoragainstandfromtheconsequencesofthematter.有义务做产生于、起因于保障某人免于……TheContractorshallpaytothenominatedSubcontractortheamountswhichtheEngineercertifiestobedueinaccordancewiththesubcontract.TheseamountsplusotherchargesshallbeincludedintheContractPriceinaccordancewithsub­paragraph(b)ofSub-Clause13.5[ProvisionalSums],exceptasstatedinSub-­Clause5.4[EvidenceofPayments].BeforeissuingaPaymentCertificatewhichincludesanamountpayabletoanominatedSubcontractor
