论教唆自杀行为的刑事责任认定.docx

PAGE\*MERGEFORMATIIPAGE\*MERGEFORMATIII摘要教唆自杀行为近年来不断引起人们的关注，也引发了舆论的讨论。通过结合我国现有的刑法规定与各种理论学说、司法实践来对教唆自杀行为所涉及的法律问题进行研究与探讨。由于我国还没有针对教唆自杀行为的全面、具体规定，所以对此的相关定性具有比较大的争议，但由于现实中难解的问题，还是需要认定教唆自杀行为的刑事责任。因此笔者在文中会对教唆自杀行为的概念、类型进行界定，论证教唆自杀行为的可罚性，从而延伸出如何对教唆自杀行为的刑事责任进行认定。生活中涉及教唆自杀行为的情形有很多种，这意味着每个案件里的教唆者的刑事责任也不同，所以先确定教唆自杀的概念与讨论范围、划分类型。如广义的教唆自杀行为与狭义的教唆自杀行为，根据两种不同情形分析各自的入罪路径，理清不同教唆者的刑事责任，再讨论出让狭义的教唆自杀行为能在司法实践中更可行、有效的标准。关键词：教唆自杀可罚性分析刑事责任ABSTRACTInrecentyears,thebehaviorofabettingsuicidehasattractedpeople'sattentionandarousedthediscussionofpublicopinion.Combinedwiththeexistingprovisionsofcriminallawandvarioustheoriesandjudicialpractice,thispaperstudiesanddiscussesthelegalissuesinvolvedinabettingsuicide.SincethereisnoclearregulationonabettingsuicideinChina,thereisabigdisputeontherelevantqualitativeanalysis,butitisnecessarytoidentifythecriminalresponsibilityofabettingsuicideforthepracticalproblems.Therefore,theauthorwilldefinetheconceptandtypeofabettingsuicideinthispaper,anddemonstratethepunishablenatureofabettingsuicide,soastoextendtheidentificationofthecriminalresponsibilityofabettingsuicide.Therearemanycasesinvolvedinabettingsuicide,whichmeansthatthecriminalresponsibilityofabettingsuicideisalsodifferent,soweshouldfirstdeterminetheconceptofabettingsuicideanddiscussthescope,classificationoftypes.Forexample,inthebroadsenseofabettingsuicideandinthenarrowsenseofabettingsuicide,theauthorwillanalyzetheirrespectivecriminalizationpathsaccordingtotwodifferentsituations,clarifythecriminalresponsibilityofdifferentabettingsuicide,anddiscussthenarrowsenseofabettingsuicideinthepracticaloperationofmorefeasibleandeffectivesentencingstandards..Keywords:AbettingsuicidePunishableanalysisCriminalresponsibility目录TOC\o
