离婚救济制度探析.docx

摘要离婚救济通常是对离婚当事人所实行的有关人身和财产的救济措施对离婚当事人离婚后的生活影响重大。自2002年开始我国离婚率就一路走高当前数据显示2015年离婚率为2.8这是2002年的3倍之多一方面以往适用较少的离婚救济措施逐渐进入大众视野另一方面也对保障离婚当事人合法权益的离婚救济措施的具体实施提出了考验。我国离婚救济制度立法时间较早随着时间推移在处理如今的离婚案件有些许不足。笔者首先通过对我国的离婚救济制度基本理论及特征进行详解然后对我国离婚救济制度现阶段存在的问题进行分析分析发现离婚救济举证困难赔偿率低、经济帮助制度适用的规定过于抽象难以执行、家务劳动补偿制度条件过于苛刻、没有设立离因补偿制度等问题；其次笔者针对我国离婚救济制度存在的问题提出了建议包括完善家务劳动补偿制度家务劳务补偿的给付不应考虑夫妻财产类型、将经济帮助制度规定具体、在范围、举证、破坏婚姻的第三者等方面完善离婚损害赔偿制度;关键词：离婚救济制度;离婚率;损害赔偿;婚姻法;AbstractDivorcereliefusuallyaremedyforpersonalandpropertyrightscarriedoutbydivorcedpartieshasgreatinfluenceonthelifeofdivorcedpartiesafterdivorce.Thedivorceratehasbeenincreasingsince2002.Thecurrentdatashowthatthedivorcerateis2.8perthousandin2015whichis3timesthatof2002.Ontheonehandthepreviouslessapplicabledivorcereliefmeasureshavegraduallyenteredthepublicviewontheotherhanditalsoputforwardatestforthespecificimplementationofthedivorcereliefmeasurestoprotectthelegitimaterightsandinterestsofthedivorcedparties.Astimegoesontherearesomedeficienciesindealingwithdivorcecasesnowadays.TheauthorfirstexplainsthebasictheoryandcharacteristicsofdivorcereliefsysteminChina.ThenitanalyzestheexistingproblemsofdivorcereliefsysteminChinaatthisstage.TheanalysisfoundthatdivorcereliefisdifficulttoproduceevidencetherateofcompensationislowandtheregulationsapplicabletotheeconomicassistancesystemaretooabstractDifficulttoexecute、Thesystemofhouseholdlaborcompensationistooharsh、Noproblemssuchastheestablishmentofthecompensationsystemandotherproblems;SecondlytheauthorputsforwardsomesuggestionsfortheproblemsofdivorcereliefsysteminChina.Includingtheimprovementofhouseholdlaborcompensationsystemandthecompensationforhouseworkservicesweshouldnotconsiderthetypesofmaritalpropertyandconcretelystipulatetheeconomicassistancesystem.Weshouldimprovethesystemo
