2论未成年人刑事责任年龄的降低摘要：随着社会发展人们文化水平显著提高我国未成年人犯罪人数总体有所下降但未成年人犯罪愈发向着低龄化的方向发展。近些年未成年人低龄化的犯罪成为社会热点问题我国在法治社会大环境下需要对这一难题作出对策目前我国对未成年人犯罪的方针是以“教育为主、惩罚为辅”对符合条件的积极运用相对不起诉、附条件不起诉等制度同时要在犯罪嫌疑人与被害人权益、社会利益间寻求平衡实现未成年人合法权益的全面、综合保护。关键词：未成年人犯罪刑事责任年龄降低OnthereductionoftheageofcriminalresponsibilityofminorsAbstract：Withthedevelopmentofsocietyandthesignificantimprovementofpeople'sculturallevelthenumberofjuveniledelinquencyinChinahasdeclinedbutthejuveniledelinquencyisdevelopingtowardsayoungerage.Frequentlyinrecentyearstheemergenceofa15-year-oldgirl'srapeafterpushingthedownstairsyiyangcityhunanprovinceyoungmatricide2boys12yearsofagewithaknifeaftercuttingorclassmateshaanxishenmu15-year-oldgirlwasbeatentodeathandsoonpeerminorsyoungeragecrimebecomesocialhotissuesandChina'scurrentlawonhasreachedtheageoffourteenminorsundertheageof16toeightcrimecriminalresponsibilityasforpersonsundertheageofaroundtenneednotbearcriminalresponsibilitycanbecarriedoutcrimeismoreandmoreintheexistinglegalprovisionsandcannoteffectivelysolvetheproblemofminorscrimecarriedoutsomepeopleputforwardtoreducetheageofcriminalresponsibilityofminorsDoesthatmakesense?IntheruleoflawinourcountrysocialenvironmenttorespondtothisproblemandisthefutureofthecountryandtheprincipleofminorcrimeinChinais"educationpunishmentsubsidiary"foreligibleactivelyuserelativenottoprosecuteconditionalnottoSuesystematthesametimetothecriminalsuspectandthevictimseekabalancebetweenrightsandinterestsandsocialinterestsachievecomprehensiveintegratedprotectionoflegitimaterightsandinterestsofminors.Undertheageof14butundertheageof16thecriminallawandthepunishmentofanypunishmentcannotreflectthedeterrentforceofthelawwhichistheurgentproblemtobesolvedintheconstructionofasocietyunderth
