中国古代录囚制度对现代服刑人员
申诉管理的启示

摘要

服刑人员的申诉问题一直是法律界研究的重点，对服刑人员申诉的关注，并且从法律角度，法院与检察院的工作角度分别予以重视有助于提高司法的公正性，促进社会和谐，维护社会安定。但是，目前我国依然存在大量的冤假错案，刑事案件的申诉问题源源不断，如何有效地处理刑事案件的申诉问题，实现对服刑人员的申诉管理可以说是我国法律界急需解决的问题。
录囚制度的最终目的就是为了平反冤假错案，实现古代司法体系的公正，维护社会安定，缓和封建社会的阶级矛盾，维护统治者的利益。录囚是我国传统司法体系的重要组成部分，历代相因，至于清末。做为制度化的存在而历时久远，并在制度体系中蕴含着传统司法思想的价值诉求与核心理念。研究古代的录囚制度并与当代的司法理念相结合，发掘并借鉴传统司法精神中的合理成分对当今司法建设的完善，推进当今司法建设的公平、公正化有着重要的意义。
本论文通过对我国古代录囚制度的分析，对录囚制度的发展历程，录囚制度的内容进行深入的分析，借鉴相关的理论精髓来处理我国的刑事申诉管理问题，并提出如何优化我国刑事案件申诉管理的对策。

Abstract
Theappealofthepersonsservingsentenceshasalwaysbeenthefocusofresearchinthelegalfield.Theattentiontotheappealofthepersonsservingsentencesandtheattentionpaidbythecourtsandprocuratoratesrespectivelyfromtheperspectiveoflawcanhelpimprovethefairnessofjustice,promotesocialharmonyandmaintainsocialstability.However,therearestillalargenumberofwrongfulandfalsecasesinChina,andthecomplaintofcriminalcaseskeepsongoing.HowtoeffectivelyhandletheappealofcriminalcasesandrealizetheappealmanagementofprisonerscanbesaidtobeanurgentprobleminChina'slegalfield.Theultimatepurposeoftheprisonerreviewsystemistorehabilitatetheunjustandfalsecases,torealizethejusticeoftheancientjudicialsystem,tomaintainsocialstability,toeasetheclasscontradictionsinthefeudalsociety,andtosafeguardtheinterestsoftherulers.PrisonrecordisanimportantpartofChina'straditionaljudicialsystem.Astheexistenceofinstitutionalization,ithasalonghistoryandcontainsthevalueappealandcoreideaoftraditionaljudicialthoughtsinthesystem.Itisofgreatsignificancetostudytheancientprisonerrecordsystemandcombineitwiththecontemporaryjudicialidea,toexploreanddrawlessonsfromthereasonableelementsofthetraditionaljudicialspiritfortheperfectionofthepresentjudicialconstruction,andtopromotethefairnessandjusticeofthepresentjudicialconstruction.ThroughtheanalysisofChina'sancientprisonrecordsystem,thispaperconductsanin-depthanalysisofthedevelopmentprocessandcontentsoftheprisonrecordsystem,andUSEStherelevanttheoreticalessencetodealwiththeproblemsofChin
