论我国强制医疗制度的完善
摘要
放眼全球，很多国家都建立了一套比较完备的强制医疗制度，但是我国的进程却很缓慢。近几年来，精神病患者犯罪案件不断增多，这也引起了对精神病患者强制医疗措施的探讨。
本文主要从以下三个方面我国的强制医疗制度完善作出了论述：
第一部分：对我国的强制医疗制度进行整体的概述。具体包括强制医疗制度的概念和特征，强制医疗制度的具体价值。
第二部分：对于我国现象法律对强制医疗制度作出的规定进行分析，同时阐述了我国的强制医疗制度存在哪些问题。
第三部分：针对第二部分提出的一些问题，从对象方面、程序的设计方面对我国强制医疗制度的完善提出自己的意见。
强制医疗程序是对精神病人自由的一种限制，因此在具体实践中，不免会造成对其合法权益的侵害。因此，强制医疗措施的实施有很大的难度。本文只是抛砖引玉，希望有更多的学者进行相关问题的研究，最终实现精神病人权益保护与社会秩序稳定的完美统一。

Abstract
Lookingattheworld,manycountrieshaveestablishedarelativelycompletesystemofcompulsorymedicaltreatmentinourcountry,buttheprocessisveryslow.Inrecentyears,criminalcasesofpsychiatricpatientscontinuetoincrease,whichalsocausedadiscussiononmedicalcompulsorymeasuresofpsychiatricpatients.
ThispapermainlyfromthefollowingthreeaspectsofChina'scompulsorymedicaltreatmentsystemperfectionisdiscussed:
Thefirstpart:thesummaryofthewholeofChina'scompulsorymedicaltreatmentsystem.Concreteconceptsandfeaturesincludecompulsorymedicaltreatmentsystem,thespecificvalueofcompulsorymedicaltreatmentsystem.
Thesecondpart:thelegalprovisionsofourcountrytomakethephenomenonofcompulsorymedicaltreatmentsystemareanalyzed,meanwhileelaboratedourcountry'ssystemofcompulsorymedicaltreatmentexistwhatproblem.
Thethirdpart:inviewofsomeoftheproblemsputforwardinthesecondpart,fromtheaspectsofdesignobject,procedurestoperfectthesystemofcompulsorymedicaltreatmentinourcountryputforwardtheirownviews.
Forcedmedicalproceduresarearestrictiononthefreedomofmentalpatients,soinpractice,willinevitablycausetheviolationofthelegitimaterightsandinterestsof.Therefore,theimplementationofcompulsorymedicalmeasureshasgreatdifficulty.Thispaperisjustabeginning,hopetohavetheresearchontherelatedproblemsofmorescholars,andeventuallyrealizetheperfectunityofspiritpatientrightsprotectionandastablesocialorder.
